DS Race Protect

DATASPORT AG, Gerlafingen offers a service with cancellation protection for participants, which can be purchased as an additional option when registering online for an event.

Participating person

The rightful holder of the DS Race Protect Option, which results from the confirmation of participation in the event, benefits from the cancellation protection. This also applies mutatis mutandis to the registration of a team/group.

Special provisions, scope and period of validity

DS Race Protect is only valid if this option is purchased during online registration for an event. Cancellation protection applies worldwide and begins with the definitive booking and ends with the start of the event (starting signal).

Covered events

Cancellation cover is granted if the participant is unable to attend the event as a result of one of the following events, provided that this occurred after the DS Race Protect was taken out:

  • unforeseeable serious illness, serious injury, serious pregnancy complications or death of the participating person, a person very close to them or a direct deputy at work, that the presence of the participating person is essential
  • Pregnancy of the participant if the date of the event is after the 24th week of pregnancy or if the event poses a risk to the unborn child
  • Serious damage to the participant's property at their place of residence as a result of fire, natural hazards, theft or water damage, making their presence at home essential
  • Cancellation or delay due to a technical defect in the concessionary public transport to the starting location

If a member of the team/group is cancelled as a result of one of the above-mentioned events, the other members are only entitled to benefits if they are related to him/her by blood or marriage.

Participants suffering from a chronic illness which does not call into question their participation in the event when purchasing the DS Race Protect will only be covered if participation has to be cancelled due to unforeseeable, severe acute aggravation of this illness or if death occurs as a result of the chronic illness.

Covered benefits and compensation

The event that triggers the cancellation of participation is decisive for the assessment of the entitlement to benefits. Preceding or subsequent events are not taken into account.

DATASPORT AG will reimburse the entry fees and additional options actually paid (excluding DS Race Protect and other options marked as excluded) if the participant is unable to take part in the booked event due to a covered event.

This benefit is limited to a total of CHF/EUR 350.

If the starting place cancelled by the participant is resold to another person by the organiser or the participant himself, there is only a claim to any transfer fees.

Exclusions

The following services are excluded:

  • The event is cancelled by the organiser or should have been cancelled for objective reasons or could not be held due to force majeure (e.g. severe weather, war). In these cases, the organiser's general terms and conditions apply.
  • The ailment that led to the cancellation was a complication or consequence of a medical treatment or option already planned when the service was purchased
  • An illness or the consequences of an accident, an operation or a medical procedure already existed at the time of registration and had not healed by the start of the event
  • The cancellation of a covered event occurs without medical indication or the medical certificate was issued more than 48 hours after the cancellation was made.
  • Cancellation due to a delay in training, even if this is due to a covered event
  • As a result of any kind of favouritism and abuse

Claims against third parties

If the participant has been indemnified by a liable third party or their insurance company, the DS Race Protect purchased will not be reimbursed.

Further provisions

  • Claims are cancelled if the DS Race Protect is requested by the participant more than 7 days after the date of the event
  • The place of jurisdiction is exclusively the Swiss domicile of the participating person or the registered office of DATASPORT AG, Gerlafingen
  • Unauthorised services must be refunded to DATASPORT AG within 30 days, including any expenses incurred as a result
  • The other provisions of DATASPORT AG's GTC and Swiss law apply

DS Race Protect claim

The participating person reports to Datasport immediately after the covered event, at the latest 7 days after the date of the event, by e-mail to [email protected].

The following details/information must be provided to Datasport:

  • Confirmation of payment from Datasport confirming the purchase of the additional option DS Race Protect
  • Medical certificate confirming the illness or injury

If the application is accepted, you will automatically receive a Datasport voucher for the amount covered by the DS Race Protect option. This enables you or other persons to register online free of charge for any event in the Datasport event calendar.

If you would like a cash payment, please let us know by e-mail to [email protected] after receiving the voucher and we will refund you the voucher amount minus a fee of CHF/EUR 10.
